We feel that the community of interest is too diverse throughout levels 1 through 10 and that a single craft or unit cannot properly represent the views of all the members involved. We propose creating a new craft or unit which will be composed of members with like interests. We believe that interests of all parties will best be served by having a craft that is united by a community of interest. If there is enough interest from the Maintenance Craft members, i.e., many signatures, we will present this petition to the leaders of the APWU and make our request to them. If they ignore our request we will have enough of a show of interest to complain to the National Labor Relations Board and to possibly request a Unit Clarification from them. The following statements are excerpts from a book which explains decisions made from cases between Unions, Employers and the NLRB. We have included them here to explain a point of view and to show the legality of this action. Also, note the many different crafts that now exist in the APWU: Motor Vehicle, Clerk, Maintenance, and Special Delivery Messenger. Why not a Technical Craft? Excerpts from Cases and Materials on LABOR LAW, by Cox, Bok, and Gorman, 9th edition: "A large unit, commonly favored by the employer, will typically be much more difficult for the Union to organize than a small one. "A large unit may engross within it employees of different skill, attitudes, and interests: the more likely there will be conflicts of interest and strains upon the union's ability to represent all unit employees fairly in negotiating and administering the collective bargaining agreement. "The smaller and the more homogeneous the unit, the more likely it is that the individual worker will be effectively represented and will have his voice heard in a democratic manner... the larger the unit, the more diluted the impact of any single employee on the shaping of Union policy. "[NLRB limitiations] protects the right of craft employees to be represented separately, in spite of an earlier certification within a more all-encompassing bargaining unit. Another forbids the Board to group professional and nonprofessional employees within a single bargaining unit unless a majority of the professional employees vote for inclusion in such unit... [and] defines a professional employee as one whose work is predominantly intellectual, requiring the constant exercise of discretion and judgement and knowledge of an advanced type acquired through prolonged, specialized, and intellectual instruction (as opposed to the routine or physical work of a nonprofessional.)"
